As the first case of swine flu is reported in Pembrokeshire the Government has produced a pandemic influenza checklist for businesses. It is estimated that within the next fortnight cases will increase to 1000 a day. This could lead to between 10 - 13% of staff absent for work for 4 or 5 days on average.

Tips and the NMW

From 1 October 2009 employers cannot use tips to top up an employee's wage so that it meets the national minimum wage ("NMW") rates. This will be of particular interest to employers in the hospitality industry. Wages will have to meet the NMW requirements, with any tips payable on top.

Holiday pay accrues during long term sick

The House of Lords has confirmed that workers on long term sick leave accrue annual leave even when they are absent from work. In the event of termination of employment, the employee will be entitled to a payment in lieu of annual leave accrued during the sick leave. This decision potentially allows employees to claim unpaid holiday from previous years.

"Sleeping in Allowance" counted towards NMW

In a recent case the Employment Appeal Tribunal decided that a "Sleeping In Allowance" of £25, which was paid to a care home worker each time he was required to sleep on the premises, would be taken into account when calculating the worker's average hourly pay for national minimum wage purposes.

Employer bound by mistake

In a recent case an employment tribunal held that an employer who mistakenly paid a part-time employee at a rate intended for a full-time person in that role was bound to continue paying the employee at the "full-time" rate.

Flexible working to avoid redundancies

A recent survey has shown that two-thirds of employers are changing working patterns in a bid to save jobs in the current economic climate. Managers are now resorting to increased flexible working hours, extended shutdowns, extra holidays and cuts in paid overtime according to the survey of 700 employers and 3 million staff.
